Environmental justice continues to remain as a top priority for the Biden Administration. Although there is no single environmental justice law, the Biden Administration continues to advance targeted environmental justice initiatives, issue executive orders, and apply a “whole-of-government” approach to incorporating environmental justice. This session will explore a few of the key components of that effort, including Executive Order 14096 (Revitalizing Our Nation’s Commitment to Environmental Justice for All), the Council on Environmental Quality’s Notice of Proposed Rulemaking for National Environmental Policy Act (NEPA) Phase II revisions, recent enforcement trends, and legal defenses being asserted by governmental and private parties. You will leave the session with a comprehensive understanding the recent environmental justice federal developments, NEPA applications, and what the future may hold.

Fred Wagner, NAEP Elected At-Large Board Member

Wager focuses on environmental and natural resource issues, associated with major infrastructure, mining, and energy project development. Fred was appointed chief counsel of the U.S. Federal Highway Administration (FHWA) during the Obama administration. Fred began his career as a trial attorney in the Environment Division of the U.S. Department of Justice. He also served as a special assistant U.S. attorney in the Misdemeanor Trial Section of the U.S. Attorney's Office for the District of Columbia. Prior to joining Venable, he spent more than 20 years in private practice at a national law firm focusing on environmental and natural resources issues.

Emily Gulick, CEP-IT
Environmental Planner
Jacobs Engineering

Emily Gulick is an Environmental Planner for Jacobs Engineering and has 4 years of industry experience. She primarily focuses on supporting large-scale and highly controversial NEPA projects for federal agencies, including NASA, DoD, and NSF and supports an internal community of practice for Environmental Impact Assessments, providing input on the latest industry trends. Emily is extremely passionate about the environmental industry and the trajectory of environmental justice. Emily also co-founded and leads the NAEP Environmental Justice Working Group. Emily holds a B.A. in Environmental Studies and a B.A. in Geography from the University of Colorado Boulder. Additionally, Emily has been a member of NAEP for her entire (albeit short) environmental career.

Stacey Halliday
Principal
Washington, DC office of Beveridge & Diamond, PC (B&D)

Stacey Sublett Halliday is a principal in the Washington, DC office of Beveridge & Diamond, PC (B&D). She co-leads the firm’s Environmental Justice Practice Group and co-founded B&D’s Corporate Environmental Justice Network. Stacey advises clients on: environmental justice strategy, policy development and project-specific implementation; ESG strategy, sustainability reporting, and green marketing risk mitigation; product stewardship, right-to-repair, and circular economy strategy; and navigation of U.S. Environmental Protection Agency investigations, enforcement, and strategic policy engagement. Stacey previously served as Special Counsel to the EPA General Counsel where her portfolio included congressional oversight, crisis management, and coordinating stakeholder engagement on behalf of the General Counsel. During her time at US EPA, Stacey advised agency senior officials in addressing the Flint Drinking Water Response, the U.S. Commission on Civil Rights investigation into EPA’s civil rights program, and broader efforts to advance international and domestic climate and sustainability initiatives.
