NEPA LEGAL AND POLICY UPDATE

 

The next National Association of Environmental Professionals (NAEP) webinar, "NEPA Legal and Policy Update," has been scheduled for Wednesday, June 20, at 1pm.  Presenters are NAEP members Lucy Swartz and Ron Bass.  The Webinar will analyze key court decisions and new developments on NEPA during 2011.  Ms. Swartz is an environmental consultant specializing in NEPA compliance, operating as a small, woman-owned business. Ms. Swartz has more than 30 years of experience in environmental law and regulation, including serving as the Deputy General Counsel at the Council on Environmental Quality (CEQ).  Ron Bass, J.D.  AICP is a Senior Regulatory Specialist at ICF International.  He has more than 30 years experience managing, preparing and reviewing NEPA documents.  He is coauthor of The NEPA Book: A Step-By-Step Guide on How to Comply with the National Environmental Policy Act and The CEQA DESKBOOK: A Step-by-Step Approach to the California Environmental Quality Act.

CEQ GUIDANCE ON NEPA REVIEW

The Council on Environmental Quality (CEQ) has issued its  guidance on ”Improving the Process for Preparing Efficient and Timely Environmental Reviews under the National Environmental Policy Act,”  that was circulated for public review and comment from December 13, 2011 through January 27, 2012. This Guidance is part of the ongoing efforts to modernize the NEPA process and expedite the permitting and other environmental decisions involved in the development of needed infrastructure projects. The Education Research & Science Working Group has collaborated with CEQ and the U.S. Forest Service to develop a webinar that will provide guidance for preparing concise and technically and procedurally adequate environmental documentation that complies with the National Environmental Policy Act.  The webinar will consider pragmatic approaches such as the effective use of the scoping process to identify and integrate the NEPA process with other applicable statutes and regulations.

Horst Greczmiel, CEQ associate director for NEPA oversight, will provide an overview of the guidance that outlines techniques and practices provided by the CEQ NEPA Regulations for agencies and practitioners for focusing and producing effective environmental documents and the related NEPA review in less time.  Mr. Greczmiel will be joined by Mr. Joe Carbone, Assistant Director for the National Environmental Policy Act, in the Ecosystem Management Coordination Branch of the U.S. Forest Service.  Mr. Carbone will share the work U.S. Forest Service has advanced in the spirit of the Guidance.

NAEP MARCH 21, 2012 WEBINAR ANNOUNCEMENT

Using Avoidance Strategies to Facilitate Review of Renewable Energy Development Projects on Public Lands

The current administration under the leadership of President Barack Obama has highlighted the development of renewable energy sources, and particularly wind and solar technologies, as a means to reduce the nation’s dependence on fossil fuels, curb climate change, improve the environment, and create jobs. Several states have followed suit by establishing their own policies to stimulate investment in alternative energy technologies.  These new policies have resulted in record numbers of right-of-way applications for renewable energy projects, and particularly wind energy farms and solar energy facilities, on publicly owned lands.  The Education Research & Science Working Group has developed an informative webinar that is aimed at sharing pragmatic guidance for streamlining the environmental compliance process, based on renewable energy projects that have been successfully entitled on public lands during the past several years.  NAEP’s goal is to provide members and other environmental professionals in the nation lessons learned from successful projects.

The webinar panel will consist of representatives from the Bureau of Land Management, enXco Development Company, Sapphos Environmental, Inc. and EMPSi. This webinar will focus on the due diligence that should be undertaken in preparing to process a right-of-way application for development of a renewable energy project on public lands.  In particular, the level of detail required for a project description and required technical studies to support the environmental evaluation pursuant to NEPA will be described and discussed.  The webinar will highlight considerations for incorporating strategies early in the project planning process to avoid significant impacts and enhance the opportunities for consistency determinations and no net effect determinations related to cultural and natural resources.

NAEP JANUARY 2012 WEBINAR

Native American Consultation for Environmental Professionals

Native American or Tribal consultation is a key element of many types of projects that an environmental professional might encounter.  Federal, state, and private project can all benefit from effective consultation.  Implementing Native American consultation early in the process can identify potential stumbling blocks (or worse) and facilitate a smoother planning process moving forward.

The NAEP Education Research & Science Working Group is organizing an informative webinar to provide background information about the benefits and application of Native American consultation in the planning process, including why it is advisable and how to avoid pitfalls in the consultation process.  NAEP’s goal is to provide members and other environmental professionals in the nation with a good understanding of what is and what is not consultation, as well as how to initiate consultation to the benefit off the full project planning team and public.

Thomas F. King, Ph.D. will lead an informative webinar discussing Native American consultation.  Dr. King will be joined by Reba Fuller.  Dr. King and Ms. Fuller will discuss why consultation is advisable with reference both to legal requirements and the practicalities of impact assessment and planning.  He will also outline some of the main issues that often trigger Native American or Tribal consultation, the etiquette surrounding consultation and what is and is not often considered correct consultation from the Native American perspective.  Dr. King and Ms. Fuller will also highlight the common causes of project delays and difficulties associated with Native American consultation.  In addition this webinar will include perspectives from a Tribal representative when discussing consultation concerns.

Thomas F. King, Ph.D.

Dr. King has spent 45 years working in cultural resource management, historic preservation, and environmental impact assessment.  He is the author of eight textbooks and one tradebook (as of 2010) on cultural resource management through Left Coast Press and Altamira Press, and editor of Wiley-Blackwell's "Companion to Cultural Resource Management" (2011).  Dr. King currently provides consultation assistance to the Department of Veterans Affairs, the Bureau of Reclamation, the Fort Mojave Indian Tribe, and other clients.  Dr. King has also been an active member of the NAEP NEPA Working Group.

 

Reba Fuller

Reba Fuller is a member of the Tuolumne Band of Me-Wuk Indians and lives on the Tuolumne Rancheria,  on the west side of the Sierra Nevada Mountains in California.  Ms. Fuller is the great-granddaughter of the late Chief William Fuller, who helped establish the Rancheria in 1907 and represented the California Indians in their pursuit of the California Indian Lands Claim Settlement.  

Ms. Fuller currently provides  liaison between the Tribe and federal, state and local agencies on proposed projects that may have a direct or indirect to tribal lands or cultural resources She has been involved for almost 40 years  in tribal affairs, and for the last 20 years has involved herself in the protection and protection of her traditional cultural heritage.  She has been instrumental in developing  the Tribe’s Cultural Committee,  agreements protecting tribal interests on proposed land projects, government-to-government relations with federal agencies, and protecting the Tribe’s intellectual property rights.

NAEP Environmental Excellence Awards Nomination Information - Deadline to submit is December 2, 2011

The National Association of Environmental Professionals (NAEP) is seeking nominations for our annual National Environmental Excellence Awards.  We are requesting nominations from you, your company, or agency describing outstanding environmental contributions from applicable projects and programs.  It is not necessary for you or your organization to be a member of NAEP and nominations may include projects or programs recognized by others.  The Environmental Excellence Award nomination(s) are to be submitted to the NAEP Awards Review Committee and must be received by December 2, 2011.  Each selected Award Winners will receive a beautiful award plaque and an invitation to briefly address participants at the Annual NAEP National Conference.  This year’s conference will be held in Portland, Oregon, May 21-24, 2012.   


 

NAEP needs “You” to serve as an elected at-large Board Member

NAEP is a voluntary association headed by a Board of Directors. The Board is composed of 12 at-large elected members from the environmental field, four ex-officio members, and one chapter representative for each 150 NAEP members in the Chapter. All serve without compensation. Each year prior to the annual conference, 4 at-large Board Members are elected to serve a three-year term of office.  For more information the requirements and expectations of an elected at-large Board Member please review the Self Nomination Form that is attached to the link below.  The deadline for submission is November 18, 2011. 

 


 

 

NAEP NOVEMBER 9, 2011 WEBINAR ANNOUNCEMENT

Recent Developments Related to the Bald and Golden Eagle Protection Act Guidelines

Recent developments related to the U.S. Fish and Wildlife  on two new permit regulations that would allow for the take of eagles and eagle nests under the Bald and Golden Eagle Protection Act (Eagle Act) will be the focus of the next webinar in the series  presented by NAEP. The Education Research & Science Working Group has been working to provide a comprehensive and informative webinar that is aimed at providing background information about the provisions of the Act, the scope of the Guidelines in relation to the development of wind energy projects, pragmatic measure to be evaluated to demonstrate the ability to achieve “no net effect,” and an overview of the litigation that has revolved around this issue.  NAEP’s  goal is to provide members and other environmental professionals in the nation with a good understanding of the current and future directions being considered or taken at the federal and state levels. 

Bald eagles were removed from the endangered species list in June 2007. In conjunction with delisting, the Service proposed regulations to create a permit program to authorize limited take of bald eagles and golden eagles where take is associated with otherwise lawful activities.  The USFWS anticipates that most permits issued under the new regulations would authorize disturbance. In limited cases, a permit may authorize the physical take of eagles, but only if every precaution is taken to avoid physical take. In  particular, the USFWS has indicated that disturbance or take of golden eagles is likely to be limited everywhere in the U.S. due to potential population declines.

Background on the Bald and Golden Eagle Act and recent guidelines will be presented by the Mr. Jerome Ford of the USFWS.  Mr. Joe Platt of HDR will present an overview of  avoidance and conservation measures that can be evaluated to demonstrated that the potential for “unauthorized take” has been avoided to the maximum extent practicable.  A third speaker that will be announced later will provide an overview of the history of litigation that has occurred in relation to the Bald and Golden Eagle Act, and recommendations for the scope of analysis to be included in environmental investigations and analysis to optimize legal defensibility.

NAEP SEPTEMBER 2011 WEBINAR ANNOUNCEMENT -

Fracking and Green Energy Development Impacts to Natural Resources

 

The NAEP presented a two-part webinar on Hydraulic Fracturing (Fracking) of formations for the production of Natural Gas and Oil. The Education Research & Science Working Group has been working to provide a comprehensive and informative webinar that is aimed at addressing much of the information and misinformation about fracking in this webinar so that our national membership can become more informed and become somewhat familiar with this issue of public interest and media attention. Our goal is to provide our membership and other environmental professionals in the nation with a good understanding of the current and future directions being considered or taken at the federal and state levels, with particular emphasis on the Pennsylvania experience. Our desire is to provide clear understanding of the truth in the field based on sound science and policy decisions.

While fracturing petroleum bearing formations is technology that has been in use since the 1940’s, the refinement of the technology for horizontal drilling has recently gotten to the point where aiming a drill string to a particular formation and depth has become more reliable. The combination of old and new technology has provided the environmental community with a real-time dilemma of how to provide for energy independence while protecting natural resources. The content of the webinar will include legal and technical aspects of the practice as well as some of the policy efforts being pursued in attempts to minimize environmental damage resulting from this practice.

Our first day (Tuesday, September 20) will have Mr. Robert Puls (USEPA) presenting the agency efforts to address groundwater and surface water impacts related to fracking and some of the research going into their developing policy. Mr. Adam Orford (Marten Law) will provide a nationwide overview of the current legal aspects of fracking. He will provide summaries of court cases and developing legal decisions related to the practice of fracking. He will also provide a more national face to the issue with information from the northeast as well as the west and south. Finally, Mr. Stuart Gruskin (Gruskin Gordon) will provide insight into how the state of New York is approaching the impending development of petroleum bearing formations in the state through a Generic Environmental Impact Statement. 

Our second installment which will be held on Wednesday, September 28 will be more focused on the issues specific to Pennsylvania and the development of the Marcellus Shale.  Pennsylvania has been on the forefront of this new technological leap and has had to address issues of groundwater and surface water impacts as the pressure to develop the Marcellus shale has increased. Mr. John Quigley (John H. Quigley, LLC) — former Secretary for the Pennsylvania Department of Conservation and Natural Resources – will frame the issue in terms of Pennsylvania’s history of resource extraction and outline current issues, public policy gaps, and a prudent, thoughtful public policy response for economic growth. Mr. Cyrille Whitson with Gannett-Fleming in Pennsylvania is a permitter for fracking well site locations in Pennsylvania. He will present the practitioner’s point of view concerning the environmental issues involved in getting a well from the conceptual stage to and through permitting and compliance, based on state law. Finally, Ms. Tamara Gagnolet – Pennsylvania Chapter of The Nature Conservancy – will present the results of a recent study completed by TNC concerning the terrestrial impacts of alternative and green energy development on the state of Pennsylvania, including fracking of the Marcellus shale and including impacts related to biomass production and wind energy development. The study looks at the potential impacts into the year 2030 and assesses the potential impact to forests and forest dependent species.

The next National Association of Environmental Professionals (NAEP) webinar, "NEPA Legal and Policy Update," has been scheduled for Wednesday, June 15, at 1pm.  Presenters are NAEP members Lucy Swartz and Ron Bass.  The Webinar will analyze key court decisions and new developments on NEPA during 2010.  Ms. Swartz is an environmental consultant specializing in NEPA compliance, operating as a small, woman-owned business. Ms. Swartz has more than 30 years of experience in environmental law and regulation, including serving as the Deputy General Counsel at the Council on Environmental Quality (CEQ).  Ron Bass, J.D.  AICP is a Senior Regulatory Specialist at ICF International.  He has more than 30 years experience managing, preparing and reviewing NEPA documents.  He is coauthor of The NEPA Book: A Step-By-Step Guide on How to Comply with the National Environmental Policy Act and The CEQA DESKBOOK: A Step-by-Step Approach to the California Environmental Quality Act.

Appropriate Use of Mitigation and Monitoring and Clarifying the Appropriate Use of Mitigated Findings of No Significant Impact” under the National Environmental Policy Act (NEPA) issued by the Council on Environmental Quality (CEQ) on January 14, 2011.  Horst Greczmiel, CEQ associate director for NEPA oversight, will provide an overview of the guidance that outlines best practices for agencies when making mitigation commitments, and sets forth guidelines for agencies when adopting a mitigated Finding of No Significant Impact.  The guidance was developed as part of CEQ's broad effort to modernize and reinvigorate federal agency implementation of NEPA, initially announced in February 2010. The new guidance affects the evaluation and adoption of mitigation and monitoring requirements in both environmental assessments and environmental impact statements. Mr. Greczmiel will be joined by NAEP board member and Sapphos Environmental, Inc. President, Marie Campbell, who will provide examples of mitigation monitoring and reporting programs that have been required in California since 1996.  We look forward to you joining us for NAEP’s inaugural webinar!

The September 1, 2010, issue of the Department of Energy (DOE) NEPA Lessons Learned Quarterly Report is now posted at http://www.gc.energy.gov/NEPA/lessons_learned.htm.

This 64th issue features reflections on the 40th Anniversary of NEPA from the DOE NEPA Community. We also continue to report on activities to enhance transparency in the NEPA process, including a new DOE policy and recent recommendations from CEQ. Standard features include NEPA litigation updates, training opportunities, meeting and conference announcements, and DOE NEPA milestones and metrics. An updated cumulative index will soon be posted online.


NAEP NEPA WG comments on CEQ Review of the Mineral Management Service's (MMS) NEPA policies, practices, and procedures for OCS oil and gas exploration

In June of this year, NAEP and the NEPA Working Group submitted comments to the Council on Environmental Quality (CEQ) for the CEQ Review of the Mineral Management Service’s (MMS) NEPA policies, practices, and procedures for OCS oil and gas exploration.  The oil spill from the Deepwater Horizon well in the Gulf of Mexico prompted this review.  The NEPA Working Group’s main comments were about the proposed restructuring of MMS into three separate agencies, the barriers to public involvement by MMS NEPA practices, and the sequence of permitting stages for OCS oil and gas activities.  On August 16th, 2010, CEQ issued its report regarding the MMS’ NEPA policies, practices and procedures for OCS oil and gas exploration. This issue is another great effort of all the volunteers who have contributed the current and past issues.  Without the work of the Board, Chapter Representatives, Committee and Work Group Leaders and the rest of the membership who provide the great ideas and content for this newsletter these improvements would not be possible.  We have some great feature articles in this issue.  The fracking article touches on an environmental issue that is starting to gain more attention nationwide.  The article on the Phipps Conservatory, while local in interest to Pittsburgh, provides great information for others that are attempting to develop sustainable building techniques.  We start our coverage of the Deepwater Horizon Incident with a first person view of what happened in Florida and bring you links to some additional publications that summarize what the Panhandle of Florida experienced.  We will be adding to this trove of knowledge as we receive articles dealing with Alabama, Mississippi and Louisiana impacts in future newsletters.  

 

This issue also has some tremendous information from our Working Groups and Committees as well as Chapter reports.  In this way our national audience can follow the local and regional events and educational offerings.  We have information on the CEQ Final Guidance for Categorical Exclusions, Results of the efforts of the Energy and Environmental Policy Committee and the Peak Oil committee.  The Sustainable Systems Working Group calls for involvement of the membership, and Yates Oppermann (RMAEP) and Owen Schmidt provide information for Transportation and NEPA professionals.

NAEP Environmental Excellence Awards Nomination Information - Deadline extended to December 1, 2010

 

The National Association of Environmental Professionals (NAEP) is seeking nominations for our annual National Environmental Excellence Awards.  We are requesting nominations from you, your company, or agency describing outstanding environmental contributions from applicable projects and programs.  It is not necessary for you or your organization to be a member of NAEP and nominations may include projects or programs recognized by others.  The Environmental Excellence Award nomination(s) are to be submitted to the NAEP Awards Review Committee and must be received by December 1, 2010.  Each selected Award Winners will receive a beautiful award plaque and an invitation to briefly address participants at the Annual NAEP National Conference.  This year’s conference will be held in Denver Colorado, April 26-29, 2011.  Award winners are required to prepare a poster for display during the entire conference. Award winners may also be asked to present their program or project in one of the technical sessions scheduled throughout the conference (optional).

NAEP needs “You” to serve as an elected at-large Board Member

 

NAEP is a voluntary association headed by a Board of Directors. The Board is composed of 12 at-large elected members from the environmental field, four ex-officio members, and one chapter representative for each 150 NAEP members in the Chapter. All serve without compensation. Each year prior to the annual conference, 4 at-large Board Members are elected to serve a three-year term of office.  For more information the requirements and expectations of an elected at-large Board Member please review the Self Nomination Form that is attached to the link below.  The deadline for submission is November 26, 2010.

NAEP Members Receive Discount for NEPA Training - March 30-31, 2010

 

Northwest Environmental Training Center offers a $100 discount for NAEP members.  "Writing the perfect EA/FONSI or EIS," a 2-day training program, is presented by NAEP member Owen L Schmidt.  The next course is in Phoenix, March 30-31, 2010.  This training course will present the NEPA practitioner a set of practical skills for preparing either an Environmental Assessment (EA) / Finding of No Significant Impact (FONSI) or Environmental Impact Statement (EIS) and includes all the required content, as well as skills for safely leaving out content that is not necessary. Thus the descriptor “perfect” refers to both the necessary and unnecessary content. NEPA lessons learned will come from various project examples.  Major themes include: how to make the findings required by law; timing the NEPA process to the decision making process; all eight good legal reasons not to prepare an EIS; scoping a reasonable range of alternatives; writing the “perfect” cumulative effects analysis; and the administrative record. Information provided includes a substantial handout with graphic models, case lists that support the models, and sample documents as well as presentation of graphical illustrations of the models. The Board of Director Elections for 2010 have been concluded!

 

At the January Board of Director's Meeting it was announced that Harold Draper, Gary Kelman and Ronald Lamb were reelected to the Board of Directors for the term ending 2013. Marie Campbell of California also won a seat on the Board as a new member. A total of 11 members were nominated to serve on the board but only four seats were up for election. Kristen Maines who has served on the board for several terms and has been a valuable asset to the Association will stay active in the NAEP by serving on one of the many Working Groups or Committees.  We thank all of those who expressed an interest in serving on the NAEP Board of Directors and encourage you all to reapply next year. Our Board of Directors elections are run in fall of each year for four positions.

 

The NAEP Board of Directors is composed of 12 elected at-large NAEP Members, a NAEP Representative from each of the NAEP Chapters, and four Ex-offico members. Chapters get one NAEP Representative for each 150 NAEP General Members in their area. The board meets quarterly at various locations around the Country. Between meetings the Association is managed by an Executive Committee composed of the Association's Elected Officers and the immediate Past President.  These officers form an Executive Committee that meets by tel-conference twice monthly.

 

The Elections Committee now turns its efforts to the annual election of our NAEP National Officers: President, Vice President, Secretary and Treasurer. That elections process should be concluded by the end of March. The National Officers and new Board Members will be installed at our Annual Meeting in April.

NAEP Board of Directors Voting Is Now Open

NAEP is a voluntary association headed by a Board of Directors. The Board is composed of 12 at-large elected members from the environmental field, four ex-officio members, and one chapter representative for each 150 NAEP members in the Chapter. All serve without compensation. Pennsylvania AEP 2010 Annual Conference
The 2010 PAEP Annual Conference is taking place at the Bear Creek Mountain Resort and Conference Center in Macungie, PA, May 12 – 14, 2010.  The Conference Planning Committee is seeking your assistance.  We are asking you to let us know of any suggestions that you might have for speakers and/or topics that you feel would be of interest to the attendees.  Is there a topic you would like to hear more about?  Feel free to volunteer yourself - perhaps there is a topic you would like to share with the group, or maybe there is something innovative or new happening in your profession/field of expertise.

NAEP Energy and Environmental Policy Committee – Call for Volunteers

 

NAEP is looking for volunteers to serve on its Energy and Environmental Policy Committee.  The committee has several important roles to play with respect to environmental policy both nationally and locally at the chapter level..  Commenting on national legislative affairs is a mainstay of activity for NAEP. NAEP wants to keep you, the membership informed of rapidly changing regulatory impacts.

 

Committee members are wanted to help form a vision statement for the committee along with establishing objectives and short-term and long term goals.  We will create a web page for the committee to facilitate communication and provide information to NAEP members. Committee members will have an opportunity to track proposed regulatory and environmental policy changes and to comment on regulations from federal agencies that effect the environment in some way. The committee will also work with other NAEP committees in developing a national presence with federal agencies.

 

The committee will work closely with the NEPA Working Group on preparing PowerPoint presentations on NEPA that are uniquely NAEP’s and that can be used for training and informational purposes by NAEP and its state chapters.  These presentations will be peer reviewed, referenced and key websites provided.  Additional program work will be defined by the committee once it is established.

National Environmental Excellence Awards Submission Deadline Extended to December 1, 2009

 

The National Association of Environmental Professionals (NAEP) is seeking nominations for our annual National Environmental Excellence Awards.  We are requesting nominations from you, your company, or agency describing outstanding environmental contributions from applicable projects and programs.  It is not necessary for you or your organization to be a member of NAEP and nominations may include projects or programs recognized by others.  The Environmental Excellence Award nomination(s) are to be submitted to the NAEP Awards Review Committee and must be received by December 1, 2009.  Each selected Award Winner will receive a beautiful award plaque and an invitation to briefly address participants at the Annual NAEP National Conference.  This year’s conference will be held in Atlanta, Georgia on April 27-30, 2010. Award winners are required to prepare a poster for display during the entire conference. MSECA November 3-4, 2009 Meeting

The Midwestern States Environmental Consultants Association (MSECA), www.MSECA.org, in association with the Indiana Department of Environmental Management and Purdue University is sponsoring the Midwestern States Risk Assessment Symposium on November 3,4, 2009 in Indianapolis, Indiana at the Hyatt Regency Hotel.  This year's agenda focuses on several current issues including Plume Stability, Vapor Intrusion, Nano-Particles and Risk Communication.  These issues are evolving and will have a major impact on environmental policy in the coming years.  Also included are presentations on Dealing with Datasets, Non-Detects and Exposure Analysis. The NAEP Career Development Committee Wants You! - initial call scheduled for March 10th

The Career Development Committee is seeking NAEP members who are passionate about helping college students, recent graduates, and others who are seeking advancement in their career field.  Our vision is for NAEP to be widely recognized as the professional association that is most effective in helping members and prospective members achieve their environmental career goals.  Some of the work may involve reviewing phases of the 2011 National Environmental Careers Survey that is being conducted in partnership with the Environmental Career Center; participating quarterly committee conference calls; speaking at local colleges to promote NAEP; providing career advice to students; and/or providing career advice via webinars or teleconferences.

We need people to help develop the Committee’s work plan and then work the plan.
