This session will cover current issues in the implementation and practice of NEPA. The panelists will discuss applying the concept of “fake news” in examining how NEPA documents are written, and applying creative solutions to complex historic resource impacts on an accelerated permitting schedule.

Owen Schmidt, Owen L Schmidt, LLC

The author, Owen L. Schmidt, BA, MA, JD, has more than 32 years service with the Federal Government. He served as Senior Counsel with the U.S. Department of Agriculture, Office of the General Counsel in Portland, Oregon, where he advised USDA agencies in Washington and Oregon. He was also a Special Assistant United States Attorney in the District of Oregon. Before joining USDA in 1991, he was an attorney for the Bonneville Power Administration, where he joined the legal staff after several years as an Environmental Specialist. The author received his J.D. from Northwestern School of Law of Lewis & Clark College, and a B.A. and M.A. in biology from St. Cloud State University, Minnesota. The author is a frequent author and lecturer on the National Environmental Policy Act. He was the Editor of Oregon Birds, a quarterly journal of Oregon Field Ornithologists, for 14 years (1985–99), and was a long-time member of the Oregon Bird Records Committee (1981–2017).

Brad Ketterling, VHB

Mr. Ketterling has worked as an environmental scientist for 23 years, specifically in the fields of wetland mitigation site feasibility and design, stream assessment, watershed planning, state and federal permitting, and NEPA compliance. He is currently the Director of Environmental Services - Vermont at VHB. He has managed multiple NEPA compliance projects for the Vermont Agency of Transportation and the National Park Service, including the Environmental Assessment to Repair and Stabilize the York River Shoreline to Protect the Colonial Parkway at Colonial National Historical Park. Mr. Ketterling managed the Environmental Assessment that is the subject of this presentation.
